AI grading under the EU AI Act: evaluating learning outcomes is point 3(b) of Annex III and proctoring is 3(d); inferring students’ emotions is banned.

Usually yes: point 3(b) covers systems intended to evaluate learning outcomes, and a suggested grade does that. Article 6(3) can take a system out where it does not materially influence the outcome and meets one of the four conditions there, such as a preparatory task, and never where it profiles natural persons.
For a decision taken on the basis of a high-risk system’s output that produces legal effects or similarly significantly affects them, Article 86 gives the affected person the right to clear and meaningful explanations from the deployer of the system’s role and the main elements of the decision, unless Union or national law provides otherwise, and only where Union law does not already provide it.
