What should you ask an AI vendor under the EU AI Act?

Start with who the provider is and whether the system is high-risk, because most of what a vendor owes you follows from those two answers. This free checklist from complipath.io groups the questions by what they settle, names the provision behind each one and marks as practice the questions the Regulation does not ask.

Questions

Which questions matter only for a high-risk system?

The instructions for use, the conformity assessment, the declaration and CE marking and the provider's logs: Articles 13, 16 and 19 concern high-risk systems. For any other system, ask who the provider is, what the system is for, which Article 50 obligations apply and what the contract says about your data.

Can a change we make turn us into the provider?

Yes, in three cases under Article 25(1): your name or trademark on a high-risk system, unless a contract allocates the obligations otherwise; a substantial modification after which it remains high-risk; a change of intended purpose that makes a system high-risk. Ask the vendor which changes it considers substantial before you make one.

What does a general-purpose AI model's provider owe us?

If you build an AI system on the model, its provider owes you information and documentation with at least the elements of Annex XII (Article 53(1), point (b)). If you only use the vendor's system, that runs to the vendor. Article 53(2) lifts it for open-source models with public weights, architecture and usage information, except those with systemic risk.

How does Complipath track what a vendor owes?

Vendors groups the AI systems in your register by the company behind them and marks each paper Have, Missing or Expired: a data processing agreement and the usage terms always, instructions for use where a system is high-risk and model documentation where you build on a general-purpose model it sells. Request papers writes the email for you to send.
