Questions

Is a driver fatigue camera prohibited?

Not when the use is intended for medical or safety reasons, the exception in Article 5(1), first subparagraph, point (f). Whether fatigue counts as an emotion is not settled by the text of the Act; Article 3, point (39) defines an emotion recognition system by emotions or intentions inferred from biometric data.

Is route optimisation high-risk?

Not as such. Point 2 of Annex III lists AI systems intended to be used as safety components in the management and operation of critical digital infrastructure, road traffic, or in the supply of water, gas, heating or electricity. Planning a carrier’s routes is not managing road traffic.
