Is using Google Gemini at work covered by the EU AI Act?

Questions

Is an image made with Gemini a deep fake?

Only if it is one under Article 3, point (60): content that resembles existing persons, objects, places, entities or events and would falsely appear to a person to be authentic or truthful. Where it is, Article 50(4) has the deployer disclose it, in a limited form for an evidently artistic, creative, satirical or fictional work.

Does the free version change anything?

Not for the deployer’s duties. Article 3, point (4) turns on use under your authority, not on what you pay; only use in the course of a personal non-professional activity falls outside it. Staff using a free assistant for work make the company its deployer.
